Dalmiya to move court against BCCI

Kolkata, Jul 26: Former CAB president Jagmohan Dalmiya's application against the BCCI and its CAO R S Shetty for allegedly filing false affidavit and misleading the court is likely to be moved before Calcutta High Court tomorrow.

''An affidavit filed through its Chief Administrative Officer, BCCI, has claimed that the amendments of the Rules of the BCCI made on September 29, 2000, were registered by the Registrar of Societies, Central Chennai on March 22, 2007,'' a source close to Dalmiya told UNI.

Arguments were also made by the counsels of BCCI, its president Sharad Pawar, secretary Niranjan Shah, treasurer N Srinivasan, vice-presidents Shashank Manohar and Chirayu Amin relying upon the said affidavit of the Chief Administrative Officer that the amended Rules were registered, the source said.

''On an application made by Mr Dalmiya, the Registrar of Societies, Central Chennai, informed in writing on April 11 that the issue of condoning the delay of filing the Amended Rules in 2000 by the BCCI has been referred to the government and no condonation has been granted as yet,'' the source added.

Mr Dalmiya sought further information at the end of May this year and the Joint Registrar of Central Chennai as the Information Officer reiterated on June five that no decision had been passed by the government as yet on condoning the delay and as such, the Rules amended in September 2000 were not in existence, the source alleged.

This was in fact the central theme of the case filed by Mr Dalmiya against Mr Pawar and others in BCCI, the verdict of which came in favour of Mr Dalmiya last Friday, the source claimed.

The application had been filed by Mr Dalmiya under Section 340 of the Cr PC providing that a false statement made on oath in a pending proceeding was a serious cognizable offence.
