Effective Regulation: A Boost for Legitimate Gaming Companies

Think about this: over 140 million Indians bet or gamble regularly, and that number more than doubles during the IPL season, hitting a crazy 370 million. Apparently, around $200 million gets to bet on each one-day cricket match. And it's not just India; cricket betting is booming globally, largely fuelled by the growing Indian betting market.

Worldwide, people bet on all sorts of sports, but football (soccer) is by far the biggest. Basketball is second, and then you've got baseball, horse racing, and hockey. In India, though, cricket is king. Especially the Indian Premier League (IPL) - it drives a huge amount of betting.

Effective Regulation A Boost for Legitimate Gaming Companies

Because India bans betting and gambling money transfers, offshore companies get sneaky. They use hidden ways to move money, like hawala, crypto, and other illegal methods, which hurts India's financial system.

There are over 75 betting sites aimed at Indians, and they keep running even though they're banned. To get more Indian users, they get famous Bollywood and sports stars to promote them, like Ranbir Kapoor, Kiara Advani, and many others.

The Advertising Standards Council of India (ASCI) has now partnered with three online gaming federations (FIFS, AIGF, and EGF) to combat illegal offshore betting advertisements and enhance compliance within the real-money gaming (RMG) sector. A joint monitoring cell will detect and report offshore betting and gambling ads, as well as evaluate RMG ads for adherence to ASCI guidelines. Violations will be flagged and shared with government authorities.

Since January, this collaboration has resulted in hundreds of offshore betting ads being reported to the Ministry of Information and Broadcasting (MIB), and a number of RMG ads flagged for potential violations. ASCI has also taken action against a significant number of ads in the past fiscal year, leading to platform blocking.

The gaming federations are actively promoting responsible advertising and gaming practices among their members. The Federations are making a concerted effort to prevent the proliferation of illegal platforms and unscrupulous operators and create a safer, more trusted gaming environment.

Gambling in India is governed by the Public Gambling Act, of 1867, which criminalized. gambling activities, this legislation offers limited guidance on modern online gaming.

While the online gaming industry has seen rapid growth, it has also faced an increasing threat from illegal offshore gambling platforms that exploit regulatory gaps. These platforms use aggressive marketing tactics to mislead users, posing risks to financial security, mental health, and potential criminal prosecution.

Despite efforts to prevent misleading gambling ads, the lack of robust enforcement allows offshore platforms to operate unchecked. Offshore platforms exacerbate risks associated with gambling by offering easy access without safeguards. They also deprive the Indian government of tax revenue and expose users to scams and data theft.

Regulation, when implemented effectively, can significantly benefit legitimate gaming companies facing public scepticism and criticism. It will help establish a level playing field, reduce uncertainty and risk, facilitate partnerships with other industries, such as sports leagues and media companies and enhance public perception of this industry.
