Can Thomas Partey play for Villarreal despite Rape Charges against him?

In a development that has sent ripples through both legal and football circles, Ghanaian midfielder Thomas Partey, formerly of Arsenal, has been charged with multiple counts of rape and sexual assault in the United Kingdom.

Yet, despite these serious allegations, the player appears poised to resume his professional career in Spain with Villarreal.

The situation raises a critical question: can Partey legally and ethically continue playing at the highest level of European football while facing such grave criminal charges?

What are the Charges against Thomas Partey?

The charges against Partey are substantial. On July 4, 2025, the Crown Prosecution Service in England authorized five counts of rape against him involving two women, as well as one count of sexual assault against a third. The alleged incidents reportedly took place between 2021 and 2022, during his time at Arsenal. On August 5, he appeared before Westminster Magistrates' Court, where he was granted conditional bail. The court heard that Partey is currently based in Spain, an acknowledgment of his ongoing negotiations with Villarreal. The bail conditions require him to notify authorities of any change in residence and to provide advance notice of international travel, but notably, they do not restrict him from working or playing football abroad.

Can Thomas Partey play for Villarreal?

From a regulatory standpoint, there are no barriers preventing Partey from continuing his professional career. La Liga and the Royal Spanish Football Federation (RFEF) do not impose suspensions on players merely facing criminal charges. Unless a conviction is delivered or FIFA intervenes with disciplinary action, the player is eligible for registration and selection.

As a free agent following the expiration of his contract with Arsenal at the end of June, Partey is reportedly on the verge of signing a two-year deal with Villarreal, having already undergone medical assessments. For now, neither La Liga nor the Spanish authorities appear inclined to obstruct his participation.

Still, legal eligibility is only part of the equation. The ethical dimension is harder to navigate. The charges against Partey have sparked outrage among sections of the public, especially after his name trended on social media with widespread condemnation. Villarreal, a club with a proud history and modest budget, risks considerable reputational damage by associating with a player under such serious scrutiny. In the absence of a conviction, the presumption of innocence legally protects Partey.
