Ashley Cole set to sue media for privacy violation over infidelity claims

London, Nov 13 : English footballer Ashley Cole is set to fight a legal battle over newspaper allegations that he cheated on his wife Cheryl Cole.

Cole's lawyers are suing for damages over a series of articles, which appeared in January and February this year taking about his alleged relationships with a hairdresser Aimee Walton, and models Brooke Healy and Coralie Robinson.

The 27-year-old footie idol will use the European Convention on Human Rights against Mirror Group Newspapers and News Group Newspapers, to argue that the stories contained private information, which represented an "unjustified intrusion" into his personal life, reports the Telegraph.

A similar defence was used by Max Mosley, the motorsport boss against a Sunday newspaper earlier this year that revealed he took part in a sado-masochistic orgy with five prostitutes.

The judge Mr Justice Eady had ruled in favour of Mosley, insisting that the coverage breached his right to privacy

In the lawsuit, Cole claims he was embarrassed and gravely distressed by the stories, which also upset his wife. Some of the information was false and invented.

Although his privacy action will not distinguish between true or false information.

Cole's lawyers will argue that his right to respect for private and family life under Article Eight of the European Convention on Human Rights outweighs the newspaper groups' right to freedom of expression under Article 10.

Cole, 27, and his pop star wife could be called to give evidence when the case comes up for trial next year.

In a pre-trial hearing, refuting the claims, Alexandra Marzec, counsel for Mirror Group Newspapers, said that the celebrity couple have repeatedly invaded their own privacy by giving interviews to the press about their relationship.
